Flagstaff Long-Term Disability Lawyer

Home  >  Flagstaff Long-Term Disability Lawyer

In Flagstaff, a disability claim rarely comes down to one bad day. It's the specialist appointment you had to drive to Phoenix for, the winter of missed physical therapy when I-17 closed, and a denial letter that cites medical records you never got the chance to explain.

Sandstone Law Group's Flagstaff office helps Northern Arizona workers and professionals fight long-term disability denials, from employees of hospital systems, manufacturers, and national companies with employer plans to physicians, engineers, and business owners with private policies. If your claim was denied, cut off, or stalled, the first question is which set of rules you're under. The answer sets your deadline, and some of those deadlines are short.

Which Disability Rules Apply to You in Northern Arizona?

Most Northern Arizona disability claims fall into one of two tracks, and each one has different rules and deadlines. Find yours before you respond to anything the insurer sends.

Your coverageWho usually has itRules that applyTime to challenge a denial
Employer group LTD planEmployees of private employers such as hospital systems, manufacturers, and national companiesFederal ERISA lawAt least 180 days to appeal
Private own-occupation policyPhysicians, dentists, attorneys, engineers, and business owners who bought their own coverageYour contract and Arizona law, including bad faithSet by your policy; act quickly

Public employees are the main exception. If you work for NAU, a school district, or a state, city, or county agency, your coverage may run through a state program with its own rules, which we explain below. Police officers and firefighters should also see our page on first responder disability claims.

What If Your Employer's Plan Is Governed by ERISA?

If you work for a private employer in Northern Arizona, such as a hospital system, a manufacturer, or a national company with a local site, your group long-term disability plan is almost always governed by ERISA. Federal rules give you at least 180 days to appeal a denial, and you usually have to finish that appeal before you can sue.

The appeal is where most ERISA cases are won or lost. In many cases, a federal judge decides based on the claim file the insurer built, so the medical records, doctor statements, and vocational evidence you add during the appeal are often the only evidence the court sees. ERISA also doesn't allow a jury or punitive damages. Most group plans switch from an own-occupation to an any-occupation definition at 24 months, which is when many terminations land.

Our Arizona ERISA disability page and our guide to what to do after an Arizona LTD denial walk through the appeal step by step. If your benefits ended near the two-year mark, read why LTD gets denied after 24 months.

Does ERISA Apply to Tribal Employers?

It depends on the employer and the job. Federal law treats a plan established by a tribal government as a governmental plan, outside ERISA, when its participants' work is substantially all essential governmental functions rather than commercial activities. Coverage through a tribal enterprise, such as a casino, resort, or retail business, may fall under ERISA instead.

With more than a quarter of Coconino County residents identifying as American Indian or Alaska Native, this question comes up often. Ask your HR office for the plan document or summary plan description, and bring it to your consultation. The answer decides your deadlines and where a dispute is heard.

Private Disability Policies for Northern Arizona Professionals

In a smaller market, your specialty can be the whole job. A surgeon who is one of a handful in the region, a rural dentist with a solo practice, or an engineer whose role exists at one local employer may hear an insurer argue that some other work in the same field counts as "your occupation." Strong own-occupation policies say otherwise, and Arizona law gives private policyholders remedies that ERISA doesn't, including bad faith claims when an insurer acts unreasonably.

See our pages on Arizona own-occupation disability claims, physician disability claims, dentist disability claims, and Arizona insurance bad faith.

How Is Disability Coverage Different for Arizona Public Employees?

If you work for NAU, a public school district, or a participating state, city, or county agency, your long-term disability coverage likely comes through the Arizona State Retirement System (ASRS) instead of an ERISA plan. ASRS is a governmental program run under Arizona law and administered by Broadspire, so the ERISA rules described on this page don't apply to it.

A few differences stand out. Benefits start after a six-month waiting period, the definition of disability tightens after 24 months of payments, and you have only 60 days after a written denial to send Broadspire a request for review, far less than the 180 days ERISA plans must give. Members of the Public Safety Personnel Retirement System, the Elected Officials' Retirement Plan, the University Optional Retirement Plan, and the Corrections Officer Retirement Plan aren't eligible for ASRS disability benefits at all.

If you're in the ASRS program, read the ASRS Long Term Disability employee guide and act quickly on any denial.

Why Does Distance Turn Into a Denial Reason?

Coconino County covers more than 18,600 square miles with fewer than eight people per square mile. Many specialists are a long drive away, waitlists run months, and winter storms cancel appointments. Insurers and administrators often read a gap in treatment as a gap in disability.

A three-hour round trip to see a specialist isn't a lack of care. It shows how much effort care takes. Protect your claim before the gap becomes the insurer's argument:

  1. Keep a record of every canceled or rescheduled appointment and the reason: weather, road closures, provider availability, or symptoms that made the drive unsafe.
  2. Use telehealth visits when in-person care isn't realistic, and make sure the visit notes describe your functional limits, not just your diagnosis.
  3. Ask your doctor to note in your chart when travel itself is limited by your condition.
  4. If the insurer schedules an exam in Phoenix and the drive isn't safe for you, say so in writing right away and ask for an alternative.
  5. Keep a symptom diary so the months between appointments aren't a blank page in your file.

ERISA and private policies generally require regular care from a doctor while you're on claim. A long gap invites the argument that you've recovered, even when the real reason was a closed highway or a six-month waitlist.

How Sandstone Law Group Helps Flagstaff Disability Clients

Kyle is a trial attorney licensed in Arizona and California and chairs the State Bar of Arizona's Arizona Attorney Magazine Editorial Board for 2025–2026. Both earned their law degrees at ASU's Sandra Day O'Connor College of Law, and Kyle completed his undergraduate degree at Northern Arizona University.

Frequently Asked Questions About Flagstaff Long-Term Disability Claims

Is my employer's long-term disability plan governed by ERISA?

If you work for a private employer, almost certainly. Plans from government employers, churches, and some tribal governments are usually exempt. Check your summary plan description, which should say whether ERISA applies.

How long do I have to appeal an ERISA long-term disability denial?

Federal rules give you at least 180 days from the date you receive the denial letter. Your plan may give more, so check the letter. Don't wait until the end of that window, since the appeal is usually your last chance to add evidence before a judge reviews the file.

What if I work for NAU or another public employer?

Your coverage likely runs through the ASRS Long Term Disability Program, a state program with its own rules, including a 60-day deadline to request review of a denial. ERISA doesn't apply. See the ASRS employee guide for details.

Do I have to drive to Phoenix to meet with a disability lawyer?

No. Sandstone Law Group has a Flagstaff office on East Pine Knoll Drive, and we regularly meet Northern Arizona clients by phone or video.

What if I can't see my doctor regularly because of distance or weather?

Document every missed appointment and the reason, use telehealth when you can, and ask your doctor to note travel limitations in your chart. Most ERISA and private policies expect regular care.

Does Sandstone Law Group only handle Arizona disability claims?

No. We're based in Arizona, with offices in Phoenix and Flagstaff, but we can help long-term disability claimants nationwide depending on the details of your case.
